Terms & Conditions of Sales


These general conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by SAS Société d'Exploitation du Château de Charbogne (SECC) - 11 grande rue - 08130 Charbogne. They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties. The customer acknowledges having read and accepted these general conditions of sale and the specific conditions of the reserved rate accessible on our reservation platform. The latter apply to all reservations concluded online, via our reservation platform.
Château de Charbogne undertakes not to disclose to any third party any information of any nature whatsoever, on any medium whatsoever, that the customer may have provided to it when making this reservation. These latter provisions are not, however, applicable to requests for information made by administrations and/or courts.


RESERVATION PROCESS:
Reservations made by the customer are made through the reservation platform. The booking customer may only use this site if he is of legal age and authorized to sign contracts that engage his responsibility. He is financially responsible for all his uses of the site.
The customer undertakes, prior to any reservation, to complete the information requested on the reservation form. The customer attests to the truthfulness and accuracy of the information transmitted. After the final choice of the services to be reserved, the reservation procedure includes in particular the entry of the bank card in prepayment of the deposit, the consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate before the validation of the reservation and, finally, the validation of the reservation by the customer. The customer receives a reservation confirmation email.

PAYMENT: Payment of the balance of the stay will be made at the latest one month before arrival.
A 30% deposit is taken from the customer's bank card at the time of booking (if booking directly on the site) or a transfer is expected if booking directly.                                   

The balance will be paid by bank transfer or by check or holiday vouchers. In the event of privatization of the castle (the main building and the two gîtes): a deposit of 15% is required, payment of the balance is expected no later than six months before the arrival date.

CANCELLATION CONDITIONS:
The customer is reminded, in accordance with article L. 121-21-8 12° of the Consumer Code, that he does not have the right of withdrawal provided for in article L. 121-21 of the Consumer Code.
All termination must be notified by email or post, the date of receipt by Château de Charbogne being authentic.
- More than 180 days before entry into the premises: 100 euros of administration fees will be retained.

- From 180 days to 89 days: 50% of the amount of the stay
- From 90 days to 1 day: 90% of the amount of the stay
- No-show: if the client has not shown up on the day mentioned in the contract, after a period of 24 hours and without notice given to Château de Charbogne: the entire rent is retained by Château de Charbogne, the contract is considered terminated, Château de Charbogne can dispose of its rental.

SECURITY DEPOSIT:
A security deposit of 1000 euros is required. The client must send this to the owner at the latest one week before arrival and it will be returned to the tenant within 15 days of the return of the keys, if no damage has been noted. For foreign clients or those without a checkbook, the security deposit must be paid by transfer before arrival. In the event of loss of the keys, an amount of 50 euros will be deducted as compensation from the security deposit. For the privatization of the castle, the security deposit then amounts to 5000€.

ANIMALS : Animals are not allowed within the grounds of the Château de Charbogne.

USE OF THE PREMISES: Château de Charbogne will provide the accommodation in accordance with the description it has made of it and will maintain it in a condition for use. The client will enjoy the rental in a peaceful manner and will make good use of it, in accordance with the description of the premises.
The rental is for the exclusive use of the client and his family or friends. The customer is required to respect the rules of life in use in the country, in particular not to cause any nuisance to the neighborhood, especially after 10 p.m.
The installation of tents or the parking of caravans or camper vans on the grounds of the rented property is prohibited, except with the prior agreement of Château de Charbogne.

Fireworks are prohibited without prefectural authorization.
The customer agrees to notify the lessor of any damage caused to the rental within 24 hours. Objects must remain in place in their respective rooms. Any damage or missing object will result in a deduction from the security deposit amount.
The premises must be kept clean by the customer. The furniture must be kept in good condition and the plants watered.
The customer must ensure that the premises are well ventilated to avoid any concentration of humidity and condensation. It is forbidden to throw into the toilets any object likely to block or obstruct the pipes.
Any repairs, regardless of their importance, made necessary by the customer's negligence during the rental period, will be at the customer's expense.
In the event of inconvenience beyond the control of the owner (public or private service strike, gas or electricity cuts, etc.), the customer cannot hold Château de Charbogne responsible. Similarly, in the event of administrative closure of the swimming pool decided by the Regional Health Agency, Château de Charbogne cannot be held responsible.

INVENTORY AND CONDITIONS: The rented property is considered free of damage upon arrival by the customer. The customer will have until the day after arrival at 10 a.m. to report any anomalies noted to Château de Charbogne. After this period, any damage noted will not be the responsibility of Château de Charbogne but of the customer.
If Château de Charbogne notices damage after the customer has left, it must inform the customer within eight days.

USE OF THE POOL : A pool access regulation will be sent to the client. The client agrees to respect these regulations and to ensure that they are respected by all participants in the stay (extract: no drinking or eating at the pool, children under adult supervision, mandatory soapy shower before swimming, etc.). Access to the pool is between 9:00 a.m. and 10:00 p.m.

SPECIAL HEALTH CONDITIONS : If administrative restrictions were issued by the government (localized confinement, traffic restrictions, etc.), last-minute postponements and cancellations are accepted. (€100 administration fee for cancellations)

INSURANCE: The client is required to insure the premises entrusted to him or rented to him. He must therefore check whether his main residence contract provides for the holiday extension (holiday rental). If not, he must contact his insurance company and request an extension of the guarantee or take out a specific contract, under the "holiday" clause. Proof of insurance will be required upon entering the premises or, failing that, a sworn statement.

SAFETY: Due to the particularity of the place: 16th century castle surrounded by moats, the client must be vigilant regarding the safety of his family or friends. It is the client's responsibility to keep a close eye on children. It is not recommended to approach the water's edge. Swimming is prohibited in the moats.

DISPUTES OR CLAIMS
It is recommended to contact the local tourist office which will intervene to resolve disputes amicably.
For any dispute not resolved amicably, the court of jurisdiction is that of the location of the property that is the subject of the rental.
